Terms of use for the ZiroTV app

The agreement between you and BITVIRE when you use the ZiroTV app from the App Store or Google Play.
1. Who we are
These terms are an agreement between you and BITVIRE, a sole proprietorship (eenmanszaak) registered with the Netherlands Chamber of Commerce (KvK) under number 97211699, VAT ID NL005257300B03, trading as ZiroTV (“we”, “us”).
You can reach us at support@zirotv.com for help and at info@bitvire.com for legal notices.
They apply to the ZiroTV app you install from the App Store or Google Play, and to every plan you buy in it. By using the app, you accept them.
Apple’s Licensed Application End User License Agreement governs your licence to the app from the App Store; these terms govern your ZiroTV plan and account and apply in addition. For a purchase in Google Play, Google Play’s terms govern the purchase.
2. What ZiroTV is
ZiroTV is a media player. It plays the playlists you add: an Xtream Codes login or an M3U link from a provider of your choice.
- ZiroTV includes no channels, films, series, playlists or links, and we do not sell, host or supply any.
- We have no connection with any content provider, and we do not recommend one.
- The app connects to your provider directly, and we do not check, monitor or store the streams you play.
What you need: an iPhone or iPad with the iOS or iPadOS version the App Store lists for ZiroTV, or an Android phone with Android 7.0 or later; a playlist as an Xtream Codes login or an M3U link, and for the TV guide your provider’s XMLTV guide; and an internet connection at least once every 72 hours for the plan check.
ZIROTV IS ONLY A PLAYER AND SUPPLIES NO CONTENT. YOU ARE SOLELY RESPONSIBLE FOR THE PLAYLISTS, LOGINS AND LINKS YOU ADD AND FOR MAKING SURE YOU HAVE THE RIGHT TO WATCH WHAT THEY CONTAIN. BITVIRE ACCEPTS NO LIABILITY FOR THAT CONTENT, SUBJECT TO SECTION 13.
What you pay for is the software, nothing else.
3. Free trial
Each device gets a free trial of 7 days, starting the first time ZiroTV opens on it. The trial includes every feature and needs no account and no payment details.
It is the only trial: neither the App Store nor Google Play adds an introductory offer or a free period to a plan. When the trial ends, the app asks you to choose a plan, and nothing is charged until you buy one. There is one trial per device, and we may refuse or end trials that are used to get around that.
4. Plans
Every plan includes every feature and covers two screens. In the app, you can buy:
- a monthly or a yearly subscription, which renews automatically at the end of each period until you cancel it (section 5);
- a lifetime plan, a one-time purchase that never renews (section 9).
The price of each plan is the one the App Store or Google Play shows in the app before you confirm the purchase.
5. Payment and renewal
You buy a plan through the App Store with your Apple ID, or through Google Play with your Google account. Apple or Google takes the payment, and its own terms apply to it as well as these terms. We never see your payment details.
A subscription renews automatically, and the Apple ID or Google account that bought it is charged for each new period, unless you cancel before the current period ends (in the App Store, at least 24 hours before). You manage or cancel it with the store:
- App Store: in your iPhone or iPad settings, open Settings, tap your name, then Subscriptions, or open your account in the App Store.
- Google Play: in the Google Play app, tap your profile picture, then Payments and subscriptions and Subscriptions.
After you cancel, your plan keeps working until the end of the period you have paid for, and it is not renewed. Removing the app from your device does not cancel a subscription.
6. Refunds
- App Store: a purchase is refunded by Apple, which sells the plan to you and handles your statutory right of withdrawal: ask at reportaproblem.apple.com.
- Google Play: a purchase is refunded by Google within 48 hours of the purchase, as Google explains on support.google.com/googleplay. After that, email support@zirotv.com and we refund it through Google Play where these terms or the law give a refund.
Where these terms give you a refund that a store cannot pay, such as for a lifetime plan, we pay it to you directly, based on the price you paid in the store.
7. Your account and devices
A ZiroTV account is optional. A plan you buy in the app works on that device without one, and restoring your purchases in the app brings it back after a reinstall.
- A plan covers two screens, TVs or phones, signed in at the same time.
- Creating an account in the app, with your email address and a password, lets your plan reach your TV and your other devices: you add a device by signing in on it.
- Signing out on a device frees its place for another one.
Your account is for you and the people you live with. You may not sell, rent or share it outside your household. Keep your password to yourself: you are responsible for what happens in your account, unless it happens because we failed to protect it.
8. Deleting your account
You can delete your ZiroTV account in the app’s settings at any time, or ask us to by emailing support@zirotv.com. Your other devices are then signed out.
Deleting your account does not cancel a store subscription. Apple or Google keeps renewing it until you cancel it with the store (section 5). As long as a purchase is still valid, restoring your purchases in the app brings the plan back on that device.
9. Lifetime plans
Lifetime means for as long as ZiroTV is offered, and in any case for at least 5 years from the day you buy it. There is no recurring payment. If we stop offering ZiroTV by our own choice within those 5 years, we refund the unused part of the 5 years: the price you paid, times the days left of the 5 years, divided by 1825. If a law, a court ruling or an order from an authority makes us stop, we owe no further compensation, but we still refund the unused part of the 5 years in the same way. After the 5 years, we email you at least 3 months before ZiroTV stops, and no refund is due. Should that day come, we also publish one last build with everything unlocked, free, for everyone. Your playlists are your own, so the app you paid for keeps playing them.
We pay that refund through Google Play for a Google Play purchase. Apple does not let us refund an App Store purchase, so for one of those we pay it to you directly. Either way it is based on the price you paid in the store.
A lifetime plan covers the same devices and features as a subscription, including new versions of the app. It belongs to the Apple ID or Google account that bought it.
10. Acceptable use
These are not allowed:
- Using ZiroTV to watch or share streams you have no right to
- Copying, changing, decompiling or reverse engineering the app, except where the law allows it
- Selling, renting or redistributing ZiroTV, or access to an account
- Bundling ZiroTV with content, playlists or links, or selling devices with ZiroTV and sources already set up on them
- Using the ZiroTV name or logo to sell or promote IPTV services or any other content
- Getting around the trial, the device limit or the plan check, or interfering with our servers
What happens when these rules are broken is in section 14.
11. Your playlists and data
The playlists you add stay yours, and you must have the right to use every one of them. When you are signed in with cloud sync on, we store your playlists so they reach your other devices, with their logins and links encrypted. How we handle personal data is in our privacy policy.
12. Updates and availability
We provide the updates, including security updates, needed to keep ZiroTV working as described for as long as your plan runs (Title 7.1AA of the Dutch Civil Code). We tell you what an update changes and what happens if you do not install it. The App Store or Google Play installs the updates.
- Whether your provider’s streams work depends on your provider, and we cannot promise that a particular provider, playlist, channel or stream works or keeps working. ZiroTV itself must play standard Xtream Codes and M3U playlists; if it does not, see section 13.
- We aim to keep our servers available at all times, but we may need short breaks for maintenance, and faults can happen. Without a connection, the app keeps working for up to 72 hours; after that, it needs to connect again.
We change ZiroTV only for a valid reason: security, the law, keeping it working with providers and platforms, or improving it. A change costs you nothing. If a change has more than a minor negative effect on your access to or use of ZiroTV, we tell you at least 30 days before it happens what will change and when, in the app and, if you have an account, by email. You can then end your plan free of charge within 30 days after that notice or the change, whichever is later: email support@zirotv.com, and we refund the unused part of what you paid within 14 days, through Google Play or, where the store cannot, directly to you. Cancel a subscription with the store as well, so it does not renew (section 5). For a lifetime plan, we refund the unused part of the 5 years as described in section 9.
13. Liability
ZiroTV must conform to these terms. If it does not, you can ask us to put it right free of charge, within a reasonable time and without serious inconvenience to you. If that is impossible, does not happen in time, the problem returns or is serious, you can ask for a proportionate price reduction or end the contract. You keep every other right the law gives you when a product does not conform.
- We are not liable for the content, availability or quality of your provider’s streams, or for outages at your provider or your internet connection.
- Nothing in these terms limits our liability for death or personal injury, or for damage caused by our intent or gross negligence, or limits your statutory rights as a consumer.
- If you use ZiroTV as a business, our total liability to you is limited to what you paid for ZiroTV in the 12 months before the event that caused the damage.
14. Suspension and termination
We may suspend or close your account, or stop your plan from working, if you seriously or repeatedly break the rules in section 10, or if the law requires it. Where we can, we warn you first and give you time to stop.
You can stop using ZiroTV at any time. A subscription keeps renewing until you cancel it with the store, even after you delete your account (section 8).
15. Complaints
Not happy with something? Email support@zirotv.com with a description of the problem and, if you have one, your account email address.
We confirm that we received your complaint and send a full answer within 14 days. If we need longer, we tell you within those 14 days when you can expect it.
If we cannot solve it together, section 16 says which courts can decide the dispute.
16. Governing law and courts
These terms are governed by the law of the Netherlands. If you are a consumer, this does not take away the protection that the mandatory law of the country of your habitual residence gives you. As EU law guarantees, you can take a dispute to the courts of the Netherlands or of the country where you live, and we can take a dispute against you only to the courts of the country where you live. If you use ZiroTV as a business, disputes go to the competent court in the Netherlands.
17. Changes to these terms
We may update these terms, for example when the app or the law changes. The date at the top of this page shows when they last changed. A change applies from its date to new purchases and renewals. If a change affects you, we tell you at least 30 days before it applies, in the app and, if you have an account, by email, and you can cancel your subscription before then if you do not agree. A change to your disadvantage never reduces what a plan you already paid for includes. If one would, you can end your plan and we refund the unused part of what you paid, as in section 12. For a lifetime plan, we refund the unused part of the 5 years as described in section 9.
